Data Collections And Uses

Scope

PURPOSE

 

Protecting the privacy and confidentiality of personal information is an important aspect of the way Netrix Logistics conducts its business. Collecting, using, and disclosing personal information in an appropriate and responsible manner is fundamental to Netrix Logistics’ daily operations.

 

SUMMARY

This policy applies to any users of Netrix Logistics and its affiliates’ (“Netrix”) services anywhere in the world, including any users of Netrix apps, websites, software, features, or other services.

This policy applies to any users of the services of Netrix or its affiliates anywhere in the world, and to anyone else who contacts Netrix, leases or uses Netrix software, or otherwise submits information to Netrix This includes those who use Netrix or its affiliates' services to:

  • Request or receive deliveries (customers and delivery recipients)

  • Provide delivery services individually or through partner transportation companies (delivery  partners)Administer the provision of delivery services through Netrix Logistics software (clients)

  • Any other user of Netrix services (including apps, websites, software and API), and anyone else who contacts Netrix or otherwise submits information to Netrix, unless subject to a separate privacy policy, notice or agreement.

Data Controller

Netrix provides services in Canada in accordance with the Information Protection and Electronic Documents Act (PIPEDA) and acts as the data controller for your information.  Netrix assumes full accountability for the personal information within its possession and control. The Information We Collect

SUMMARY

Netrix collects:

  • Information that you provide to Netrix, such as when you create your Netrix account.

  • Information created when you use our services, such as location, usage and device information.

  • Information from other sources, such as Netrix partners and third parties that use Netrix’s API.

Netrix collects the following categories of information:

  1. Information you provide

This includes information submitted when you:

  • Create or update your Netrix account, which depending on your location and the Netrix services you use may include your name, email, phone number, login name and password, address, payment or banking information, government identification numbers, birth date, and photo

  • Submit information about your vehicle or insurance (for delivery partners)

  • Request services through an Netrix app or website

  • Contact Netrix, including for customer and client support

  • Contact other Netrix users through our services

  • Lease or use Netrix software to administer delivery services

  1. Information created when you use our services

This includes:

  • Location Information

Depending on the Netrix services that you use, and your app settings or device permissions, Netrix may collect your precise or approximate location information as determined through data such as GPS, IP address and WiFi.

  • If you are a delivery partner, Netrix collects location information when the Netrix app is running in the foreground (app open and on-screen) or background (app open but not on screen) of your device.

  • If you are a customer, Netrix may collect location information when the Netrix app is running in the foreground. In certain regions, Netrix may also collect this information when the Netrix app is running in the background of your device if this collection is enabled through your app settings or device permissions.

  • Customers and delivery recipients may use the Netrix app without enabling Netrix to collect their location information. However, this may affect the functionality available on your Netrix app. For example, if you do not enable Netrix to collect your location information, you will have to manually enter your pickup address. In addition, location information will be collected from the delivery partner during the course of delivering your order, even if you have not enabled Netrix to collect your location information.

  • Transaction Information

We collect transaction details related to your use of our services, including the type of services you requested or provided, date and time the service was provided, amount charged, distance of the delivery, and other related transaction details.

  • Usage Information

We collect information about how you interact with our services. For example, Netrix may store aggregate, non-identifying information relating to customer login locations, order placement locations, and delivery pickup and drop-off locations. 

  • Device Information

We may collect information about the devices you use to access our services, including the hardware models, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, and mobile network information.

  • Log Information

When you interact with our services, we may collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with our services.

  1. Information from other sources

These may include:

  • Users providing feedback, such as ratings or compliments

  • Netrix business partners through which you create or access your Netrix account, such as payment providers, social media services, or apps or websites who use Netrix's APIs or whose API Netrix uses

  • Insurance providers (if you are a delivery partner)

  • Financial services providers (if you are a delivery partner)

  • Netrix affiliates (if you are a delivery partner who uses our services through a lessee of Netrix software)

  • Partner transportation companies (if you are a delivery partner employed by a third party transportation company doing work on behalf of Netrix)

  • Publicly available sources

  • Marketing service providers

 

Netrix may combine the information collected from these sources with other information in its possession.

How We Use Your Information

SUMMARY

Netrix collects and uses information to ensure reliable and convenient delivery. We also use the information we collect:

  • To enhance the security of our users and efficiency of our services

  • For customer support

  • For research and development

  • To enable communications to or between users

  • In connection with legal proceedings

Netrix does not sell or share your personal information to third parties for third party direct marketing purposes.

Netrix uses the information it collects for purposes including:

  1. Providing services and features

Netrix uses the information we collect to provide, personalize, maintain and improve our products and services. This includes using the information to:

  • Enable deliveries and related services

  • Process or facilitate payments for those services

  • Offer, obtain, provide or facilitate insurance or financing solutions in connection with our services

  • Enable features that allow you to share information with other people, such as submitting driver ratings, tracking package locations, or accessing administrative support services  

  • Enable features to personalize your Netrix account, such as uploading your photo

  • Perform internal operations necessary to provide our services, including to troubleshoot software bugs and operational problems, to conduct data analysis, testing, and research, and to monitor and analyze usage and activity trends

  1. Service Efficiency and Security

We use your data to help maintain efficiency, security, and integrity of our services. For example, we track the locations of all logged-on delivery partners in real-time in order to ensure on-time deliveries; for the provision of the most time-efficient delivery routes; and for real-time tracking to provide customers with the location of their ongoing deliveries. Netrix also collects delivery partner trip information and uses real-time analytics to compare actual delivery times with estimated Google trip times. The resulting information may be used when assigning packages to delivery partners in order to ensure on-time delivery.

  1.  Support Services

Netrix uses the information we collect to assist you when you contact our support services, including to:

  • Direct your questions to the appropriate support person

  • Investigate and address your concerns

  • Monitor and improve our support responses

  1. Research and development

We may use the information we collect for testing, research, analysis and product development. This allows us to improve and enhance the efficiency and security of our services, develop new features and products, and facilitate insurance and finance solutions in connection with our services.

  1. Communications among users

Netrix uses the information we collect to enable communications between our users. For example, a delivery partner may text or call a customer to confirm a pickup or drop-off location, or a service administrator may call a customer or delivery recipient with information about their order.

  1. Communications from Netrix

Netrix may use the information we collect to communicate with you about products, services, promotions, studies, surveys, news, updates and events. Netrix may also use the information to promote and process contests and sweepstakes, fulfill any related awards, and serve you relevant ads and content about our services and those of our business partners. Netrix may also use the information to inform you about elections, ballots, referenda and other political and policy processes that relate to our services.

  1. Legal proceedings and requirements

We may use the information we collect to investigate or address claims or disputes relating to your use of Netrix's services, or as otherwise allowed by applicable law.

Cookies And Third Party Technologies

SUMMARY

Netrix and its partners use cookies and other identification technologies on our apps, websites, and emails, for purposes described in this policy.

Cookies are small text files that are stored on your browser or device by websites, apps, online media, and advertisements. Netrix uses cookies and similar technologies for purposes such as:

  • Authenticating users

  • Remembering user preferences and settings

  • Determining the popularity of content

  • Delivering and measuring the effectiveness of advertising campaigns

  • Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our services

From time to time we may also allow others to provide audience measurement and analytics services for us, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, SDKs, and other technologies to identify your device when you visit our site and use our services, as well as when you visit other online sites and services.

Information Sharing and Disclosure

SUMMARY

Some of Netrix’ products, services and features require that we share information with other users or at your request. We may also share your information with our affiliates, subsidiaries and business partners, or for legal reasons or in the event of a dispute.

Netrix may share the information we collect:

  1. With other users

  • For example, if you are a customer or delivery recipient, we may share your name, your phone number,  and delivery pickup and/or dropoff locations with delivery partners assigned to your order.

  • If you are a delivery partner, we may share information with customers for whom you are delivering or the delivery recipients. Such information may include your name and photo; your vehicle make, model, color, license plate; your location; and contact information (depending upon applicable laws). The customer will also receive a receipt containing information such as a breakdown of amounts charged, a map of the route you took, delivery request and fulfillment times, and other transaction details.

  1. At your request

This includes sharing your information with:

  • Other people at your request. Where appropriate, Netrix may ask for the request in writing.

  • Netrix business partners. For example, if you requested a service through a partnership or promotional offering made by a third party, Netrix may share your information with those third parties. This may include, for example, other apps or websites that integrate with our APIs or services, or those with an API or service with which we integrate, or business partners with whom Netrix may partner with to deliver a promotion, a contest or a specialized service.

  1. With the owner of Netrix accounts that you may use

If you use a profile associated with another party we may share your trip information with the owner of that profile. This occurs, for example, if you are:

  • A customer using your employer's Netrix business profile

  • A delivery partner using an account owned by a partner transportation company

  1. With Netrix subsidiaries and affiliates

We share information with our subsidiaries and affiliates to help us provide our services or conduct data processing on our behalf. For example, Netrix may process or store information in the Canada on behalf of its subsidiaries and affiliates.

  1. With Netrix service providers and business partners

Netrix may provide information to its vendors, consultants, marketing partners, research firms, and other service providers or business partners. For example, Netrix may provide information to such parties to help facilitate insurance coverage, to conduct surveys on our behalf, and to process payments for our services.

  1. For legal reasons or in the event of a dispute

Netrix may share your information if we believe it is required by applicable law, regulation, operating agreement, legal process or governmental request.

  • This includes sharing your information with law enforcement officials, government authorities, or other third parties as necessary to enforce our Terms of Service, user agreements, or other policies, to protect Netrix' rights or property or the rights or property of others, or in the event of a claim or dispute relating to your use of our services. If you use another person's credit card, we may be required by law to share information with that credit card holder, including delivery information.

  • This also includes sharing your information with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

Netrix may share your information other than as described in this policy if we notify you and you consent to the sharing.

Information Retention and Deletion

SUMMARY

Netrix retains your information after an account is created, unless you request deletion of your information or account. In some cases we may retain certain information about you as required by law or other purposes as described in this section even if you delete your account.

Netrix retains your information after an account is created, unless you ask us to delete your information or your account. Subject to the exceptions described below, Netrix deletes your information upon request.

 

Subject to applicable law, Netrix may retain information after account deletion:

  1. If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute;

  2. If we are required to by applicable law; and/or in aggregated and/or anonymized form.

  3. Netrix may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, if Netrix shuts down a user's account because of unsafe behavior or security incidents, Netrix may retain certain information about that account to prevent that user from opening a new Netrix account in the future.

 

Choice and Transparency

SUMMARY

Netrix provides means for you to see and control the information that Netrix collects, including through:

  • In app privacy settings

  • Device permissions

  • Marketing opt-outs

Privacy Settings

The Profile page in the Netrix app gives users the ability to set their preferences for receiving mobile notifications from Netrix.

 

Device Permissions

Most mobile platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without your consent. And these platforms have different permission systems for obtaining your consent. The iOS platform will alert you the first time the Netrix app wants permission to access certain types of data and will let you consent (or not consent) to that request. Android devices will notify you of the permissions that the Netrix app seeks before you first use the app, and your use of the app constitutes your consent.

 

Accessing and Correcting Your Information

You can edit the name, phone number, email address, photo, and vehicle documentation associated with your account through the Profile page of Netrix’ apps or online at driver.netrixlogistics.com. You can also look up your deliveries, orders and deliveries history in the Netrix app. Delivery partners can access all the personal information they have submitted to Netrix by accessing their profile on driver.netrixlogistics.com. Delivery partners working with an affiliate should consult their administrator for the portal web address relating to their instance. Netrix customers can access all the personal information they have submitted to Netrix by accessing their profile online by logging into netrixlogistics.com.

 

Marketing Opt-Outs

You may opt out of receiving promotional emails from Netrix by clicking on the unsubscribe link in the promotional email. Please note that if you opt out, we may still send you non-promotional messages, such as receipts for your rides or information about your account.

Updates to This Policy

Netrix reviews its Privacy Policy:

  • On annual basis

  • As may be required by applicable law

  • Upon changes or amendments to legislation impacting the Policy

Netrix reserves the right to make changes to the Policy at any time, for any reason, and without prior notice to product users. Users of Netrix products, including our apps, websites, software, or APIs, will be notified when a change to the Policy is made and will be required to consent to the updated Policy prior to continuing to use Netrix services[D1] .
